Slip and Fall Accidents: What Must Be Proven

As explained by AllLaw in their article “What You Must Prove to Win a Slip and Fall Injury Claim”, liability is the central issue in slip and fall cases. To recover compensation, an injured person must prove that the property owner—or their employee—was legally responsible for the unsafe condition that caused the accident. This may include hazards such as potholes, uneven flooring, or obstacles left in walkways.

Courts and insurers typically evaluate whether a reasonable property owner should have recognized and fixed the hazard or whether they directly caused it. Responsibility can apply to businesses, homeowners, or even employers depending on where the accident occurred.
