What Makes a Slip and Fall Case Legally Valid?

As explained by the New York City Bar Association in their article “What are the elements of a slip/trip and fall case?”, not every fall leads to a lawsuit—but when negligence is involved, legal action may be justified.

Slip and fall—or trip and fall—cases generally arise when a person is injured due to a dangerous condition on a walking surface. These conditions can include water, ice, oil, soap, debris, uneven flooring, or poorly maintained sidewalks. However, to hold a property owner liable, a key legal threshold must be met: negligence.
