When Birth Injury Funds Fall Short for Families

As reported by The New York Times in the article “Fund to Aid Children Harmed at Birth Hasn’t Kept Promises, Families Say,” the story of GianRaul Olivio highlights the painful reality many families face after a traumatic birth injury—and the often insufficient support from systems intended to help them. Despite a $6.5 million settlement after a prolonged legal battle, the Olivio family spent years navigating hospitalizations, seizures, and hospice care, all while waiting for the justice and support they were promised. 

GianRaul was born following a difficult labor, during which his mother’s request for a cesarean section was initially denied. When he was finally delivered, he was unresponsive, and doctors took 15 minutes to locate a heartbeat. Although he survived, the brain damage he sustained left him unable to walk, talk, or breathe on his own. His resilience earned him the nickname “G.M.O.” — short for God’s Miracle on Earth.
