NY Lawmakers Push to Expand Wrongful Death Damages

As reported by Spectrum News in the article “Is Third Time the Charm for New York Wrongful Death Statute Expansion?”, New York lawmakers have once again passed a bill that would significantly expand the state’s wrongful death statute to include emotional damages for surviving family members. This marks the third attempt to push the bill through, with hopes that revisions made in response to Governor Kathy Hochul’s prior objections will lead to her signature this time.

Attorney Terry Connors, who represents victims’ families from the 2022 Buffalo Tops mass shooting, has voiced support for the bill, noting that it’s a matter of “fundamental fairness.” One major revision to the bill is a narrowed definition of which family members can be eligible for compensation. However, the bill does not include provisions requested by opposition groups, such as limiting compensation eligibility to families of deceased minors or exempting medical professionals from liability.
